Why wouldn't the conservative majority on the Supreme Court who champion state rights uphold the AZ law?

Roberts, Alito, Thomas, Scalia and Kennedy all champion state rights





Kennedy has ruled 100% of the time in favor of state rights yet the Dems think he will rule this time to strike it down lol





Hillarious!|||There are only Four conservatives on the Supreme Court, the rest are far left Liberals. Kennedy is NOT a conservative.|||Sir or Madam, I have no reason to lie, nor did I dispute what you said regarding how a vote might go. Kennedy is not a Conservative, but not being a Conservative should have nothing to do with this issue, it about following Constitution Law. Keep lies going is a rude comment.

http://www.janbrewer.com/|||Constitutional civil liberties trump states rights. States can do what they want within the confines of the US Constitution. I'm not saying they would or wouldn't uphold it, but depending on the language of the legislation (I haven't read it) they may have no choice but to strike it down if it's found to be unconstitutional.





Edit - @ Johnny - I don't disagree with you. The fact remains that if the law is found to be unconstitutional, it will be struck down... even by a majority conservative court. That is, of course, provided they have any integrity whatsoever. Maybe you missed the part where I stated I wasn't saying they'd go one way or the other and that I hadn't read the language of the legislation. For the record, I'm a Libertarian and I do not support judicial activism in any way. This is why I maintain that there is a possibility that even a conservative court could strike down the law. Judicial activism is in large part what's gotten us where we are today. I sort of gather from your post that you think it's okay because it's already been done. Sorry, I don't roll that way.|||When Al Gore is a Justice of the Supreme Court, he will help overturn Bush v Gore.


Therefore, all Bush vetoes will be null and void.

damn libs want in both ways.....literally!|||The law will likely be challenged after a citizen - not an alien, legal or otherwise - is detained as a suspected illegal immigrant. As a citizen you should not be required to prove your residency.





I'm not going to argue against the intent of the law to discourage illegal immigration and to encourage illegals to go home. But when a law has the real possibility of infringing on the rights of citizens, it should not be allowed - no matter how valid the intent.





Just to give you an example of why I strongly oppose this law. About 2 months ago, one of my employees was in Arizona. On her way home she was pulled over for a traffic violation and had to spend about 15 minutes convincing the officer she was in fact a citizen. Yes, she is Hispanic. But she speaks perfect English with no accent. Under this law, if she had lost her license (the physical document, not the privilege of driving), she could have been arrested and put through an extensive legal process. This should not happen to an American citizen in America. Period.
